AËROLUFT® TERMS AND CONDITIONS OF USE 

These Terms and Conditions of Use govern your purchases and your use of the site https://myaeroluft.com and set a contract between you and Aeroluft Watch Company SLL, with head office in 50004 Zaragoza (Spain) Av/ Hernán Cortés, 10bis 6th (hereinafter AËROLUFT®). By purchasing from us and using this website you have agreed to these Terms and Conditons of Use. Please make sure that you have read carefully and understood them when using the website.

ORDER CONFIRMATION

Once your order has been received, we will send you an e-mail to the address you provided when you registered, which will summarize the purchase: products purchased, overall amount including taxes (if applicable), shipping costs and approximate delivery time.

PAYMENT

You may pay with either credit or debit card through the virtual POS STRIPE terminal (Verified by Visa, MasterCard SecureCode, American Express SafeKey), which is the independent electronic payment platform integrated on the website. AËROLUFT® will never be able to know the data of the debit or credit card you used, which are encrypted by STRIPE and to which we do not have any access.

When you select paying by card you will automatically leave our website to enter the STRIPE system, so your card data will never pass through us. Once the transaction is approved you will be automatically switched back to our website to end the purchase.

We accept VISA, MasterCard and American Express personal and business debit and credit cards, issued or not by banks set in the European Union, without any type of surcharge for the type of card or its place of issuance.

You can pay through PAYPAL, opening an account at www.paypal.com and following the instructions provided by the platform. Paypal is completely independent and is not linked to AËROLUFT® in any way. We do not charge any type of surcharge for using this system.

You can choose to pay by bank transfer if the payment is made from an account with address in a member country of SEPA (Single Euro Payment Area) which are the 28 member countries of the European Union as of July 2018, as well as Iceland, Lichtenstein, Monaco, Norway, San Marino and Switzerland, to the account indicated in the payment process of the website. AËROLUFT® will never charge you a commission for paying by bank wire, but be aware that your bank may charge a fee for the transfer. Please, check the conditions of your bank. Please note that the processing time of a bank wire depends exclusively on your bank, and may take up to 72 hours to be paid into our account. AËROLUFT® will not start processing your order until the payment has been confirmed by our bank.

PRICES

All prices shown on the website are expressed in EUROS. If your currency is other than the Euro, your purchase will be processed in Euros applying the exchange rate set by your bank, Paypal, or the issuer of your credit or debit card, depending on the payment method chosen. We don’t have any control over the exchange rate applied when transferring the amount in your currency into Euros, or on the fees for currency exchange that your bank, Paypal or the issuer of your credit or debit card could apply to your purchase.

All the website prices are VAT included, applying the current type of Value Added Tax applied in Spain at the time of purchase. If your purchase is made from a country outside the European Union or a territory subject to particular tax rules (such as the Canary Islands), VAT will be deducted from the price in the cart before proceeding to the payment, once you have been registered and the system has detected the country or zone from which you make your purchase. However, keep in mind that in this case your purchase may be subject to the payment of custom duties and/or taxes. AËROLUFT® is not responsible in any case for those import duties and /or taxes that the purchaser must satisfy before receiving the order. We advise you to contact your local customs office for further information about this matter. AËROLUFT® will not accept refunds for this cause in any case.

WITHDRAWAL

Purchasers from member countries of the European Union have the right to return the order within 14 calendar days since the date of receipt. This only applies if the product and the original packaging are unused and in the same condition as when received. To use this right you must contact AËROLUFT® through the contact form. AËROLUFT® will refund the money paid (including the shipping costs) in the same form in which you made the payment, except agreement between both sides. The return shipping costs will be paid by the customer.

However, once the right of withdrawal has been exercised, the payment return period varies depending on the method of payment used, which determines the return method of the amount to be paid: In any case, AËROLUFT® is obliged by law to have the money paid regardless of the method of payment used, within 14 days after receipt of the product back by AËROLUFT® and verified that it has not been used and is in its original packaging.

If the payment method used was a bank transfer, it is necessary for the refund to communicate us an IBAN code of a bank set in the country of the Single Euro Payment Area (SEPA) where the order was sent. 

The right of withdrawal is NOT applicable to personalized products, such as limited editions monogrammed with the initials or the client’s name in any part of the product. Neither is applicable if the product has obvious signs of having been used or if it is not in its original packaging: in this case AËROLUFT® may apply charges for necessary expenses to put the product back on sale.

When purchasing on the website myaeroluft.com, you must provide some minimum data to fulfill your order, such as your name, your e-mail address or your postal address. AËROLUFT® treats all personal information confidentially and never will do a transfer of your data to third parties under any circumstances. PRODUCT

AËROLUFT® reserves the right to adjust the prices, add additional costs and change product information, such as images and offers without prior notice. The product images and information texts reflect the product as much as possible. We reserve the right for typographical errors that may appear on our page and we do not guarantee that all images accurately reflect the true appearance of the watch, since the colour of the images may vary depending on the colour settings of your screen. All images must be considered as illustrations only and do not guarantee appearance or features.

SHIPPING COST AND DELIVERY

AËROLUFT® ships worldwide. Deliveries will be carried out in collaboration with accredited transport companies. Shipping cost vary depending on your order delivery area, and will be always clearly indicated before the payment. We recommend you checking the SHIPPING COST section in order to know the cost you will have to pay depending on your order delivery zone.

At our sole discretion, there may be promotions in the price of shipping costs depending on the number of items purchased. These promotions will be published in the SHIPPING COST section. These promotions will last as determined by AËROLUFT®, and may end at any time without prior notice. As long as they are published in the SHIPPING COST section, the promotions for will be valid.

The watches purchased in the FACTORY OUTLET section are expressly excluded from the discounts on shipping costs, unless otherwise indicated.

CLAIMS

As a customer, you must carefully check the products received and verify that they are not damaged. If your shipment has been damaged during transport, you must inform the transport company as soon as possible. If upon receiving your article you notice that it is damaged or does not match the one you ordered, you should contact us within a maximum period of 30 days from the date of receipt of the order. Claims should be directed to our customer service through e-mail to the address customerservice@myaeroluft.com. You must provide us the order or invoice number and the reason for your claim, and we will contact you as soon as possible. Returned defective products must be treated as if they had no defects: It is important that in all returns the product is packed in such a way that it can not be damaged during transportation. AËROLUFT® will replace the defective products with others of the same model. If the item is discontinued or is not in existence at the time of the claim, the customer may choose between a refund of the full amount paid or receive another model of price and similar characteristics. In the event that we can’t find errors or failures, the product will be sent back to the customer.

LIABILITY

Although it will do everything possible to achieve that 100% of the products arrive within the established period, AËROLUFT® will not is responsible for the damages caused by possible delays in the delivery that are attributable to the transport companies that must deliver the purchased product.

FORCE MAJEURE

We will be exempt from liability for damages and other penalties if the execution of the contract prevented, hindered or delayed by circumstances beyond AËROLUFT®’s control, such as government intervention, new or modified law, absence of state, war, fire, flood, natural disaster, labour strikes, prohibitions, restrictions, sabotage, transport strikes, weather conditions, lack of delivery by suppliers, or exposure of the company to criminal activity that affects its activities.

INTELLECTUAL PROPERTY RIGHTS

AËROLUFT® is a registered trademark in the European Union and other countries. The brand, photographs, texts and other copyrighted material and content of the website may not be reproduced without the written authorization of Aëroluft Watch Company SLL.

USER CONTENT

The website may include user generated content, for example social media applications. AËROLUFT® does not claim any ownership or rights in such content (images, photos and videos etc.) and take no legal responsibility for it. In case you suspect a violation of copyright, or any other right, or otherwise is offended by such content, please contact us at customerservice@myaeroluft.com.

RETENTION OF TITLE

All products are property of  AËROLUFT®  until full payment is made.

GOVERNING LAW AND JURISDICTION

These Terms and Conditions of Use of the website are governed by Spanish law. To the extent permitted by law, Spanish Courts will have exclusive jurisdiction of any dispute arising from these Terms and Conditions of Use and your use of the website, subject to AËROLUFT® right to prosecute a user at his/her place of residence.

TERMINATION

AËROLUFT® reserves the right to terminate your account and/or your use of the myaeroluft.com website at its sole discretion. For example, if AËROLUFT® suspects that you have breached this Terms and Conditions of Use. Such termination can be made without prior notice.

AMENDMENTS

AËROLUFT® may update these Terms and Conditions of Use from time to time. Every time you order a product from us, the Terms and Conditions of Use in force at that time will apply to the contract between you and AËROLUFT®. You should therefore periodically visit this page to review the then current terms to which you are bound.
